Same-Sex Marriage is not currently available in New York. However, New York City does allow for same-sex domestic partnerships. In order to be eligible for domestic partnership, both parties must be at least 18 years of age, residing together in New York City, not a part of any other marriage or domestic relationship, and not barred in any other manner that would bar same-sex parties from getting married. While domestic partners are not legally considered spouses and are therefore not entitled to certain legislative benefits of marriage (such as tax benefits), they are entitled to certain rights, including being covered by the partner’s government employee benefits, and visiting the partner in a hospital.

New York does recognize same-sex marriages performed legally in other states. These marriages are given the same treatment as traditional heterosexual marriages.
